SOCOTEC was engaged by legal counsel representing a major manufacturer of commercial and residential appliances to assess alleged patent infringement damages concerning convection heat transfer technology used in rapid cooking ovens sold to convenience stores and restaurants. Along with other oven manufacturers, our client was accused of infringing on a patent related to a commercial oven designed for quick heating and toasting of food. SOCOTEC conducted a detailed evaluation of the patent holder’s damage claims and prepared an alternative calculation, applying the Panduit and Georgia-Pacific Factors to determine the appropriate damages, including a reasonable royalty rate for the disputed patent.

In response to the allegations that all rapid cooking ovens infringed upon the patent, SOCOTEC provided an in-depth analysis of similar, non-infringing products not named in the lawsuit. Additionally, we identified a simple design-around that could be implemented by our client to offer a non-infringing alternative. Shortly after SOCOTEC’s deposition testimony, the matter was settled favorably for our client.
