SOCOTEC was engaged by legal counsel representing a global biopharmaceutical company to evaluate and quantify patent infringement damages related to an innovative medication delivery system used for treating ADHD via a dermal patch. SOCOTEC conducted a thorough assessment of the damages claimed by the patent holder concerning the methylphenidate patch and developed an alternative damage calculation. This analysis involved the application of Panduit and Georgia-Pacific Factors to accurately determine the appropriate damages, including a reasonable royalty rate for the disputed patent.

In addition, SOCOTEC supported the client with a rebuttal report, critically analyzing the commercial viability of the claims and identifying the presence of alternative, non-infringing products. This rigorous analysis contributed to the court granting a motion for summary judgment in favor of our client, leading to a favorable outcome.
